1. Acceptance of Terms

By accessing and using VidHero (“Service”), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.

VidHero is an AI-powered photo-to-video platform that transforms uploaded photos into short animated videos using cutting-edge AI technology across 30+ creative styles.

2. Description of Service

VidHero provides the following services:

• AI-powered photo-to-video transformation across 30+ creative styles
• Style tools including dance, twerk, pregnant, miniature, mermaid, fight, celebrity, and many more
• Custom activity and scene prompts for personalized outputs
• AI image generation as an intermediate transformation step
• AI image-to-video animation (6-second MP4 clips)
• Video download in MP4 format

3. Pricing and Billing

Credit-Based System

VidHero operates on a credit-based system. Credits are consumed when generating videos. Credit cost varies by tool — tools using Hailuo video animation cost 5 credits per generation; tools using WAN video cost 3 credits per generation.

Subscription Plans

VidHero offers subscription plans that include monthly credit allocations. All payments are processed securely through Polar. Prices are subject to change with 30 days' notice.

• Credits included in a plan are refreshed each billing cycle
• Unused credits from a billing cycle do not roll over unless otherwise stated
• You can cancel your subscription at any time; access continues until the end of the billing period

4. User Responsibilities

As a user of VidHero, you agree to:

• Provide accurate information when creating your account
• Use the service for lawful purposes only
• Not attempt to reverse engineer or copy our AI pipeline
• Not use the service to generate harmful, illegal, or copyrighted content
• Respect rate limits and fair-use guidelines
• Only upload photos and images you have the right to use
• Not upload photos of other individuals without their explicit consent
• Not create deepfakes or impersonate others without consent
• Comply with all applicable laws, platform guidelines (YouTube, TikTok, Instagram), and regulations

5. Content and Intellectual Property

Generated Content

You retain full ownership rights to all videos and images generated through VidHero. We do not claim any ownership over content created using our service.

Content Responsibility

While we strive to generate high-quality content, you are solely responsible for:

• Reviewing all generated videos before publishing or sharing
• Ensuring you have rights to any photos you upload
• Respecting portrait rights and privacy of individuals in uploaded photos
• Meeting any disclosure requirements for AI-generated content on publishing platforms

Platform Rights

VidHero and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

6. Privacy and Data Protection

We take your privacy seriously. Our data practices include:

• Uploaded photos are stored securely on Cloudflare R2
• Generated videos and images are saved to your account for your convenience
• We use your data only to provide and improve our services
• We do not sell or share your personal information with third parties
• You can request deletion of your data at any time

7. Service Availability and Limitations

While we strive for high availability, VidHero is provided “as is” and we cannot guarantee:

• Continuous, uninterrupted service availability
• Perfect accuracy or quality of all generated videos or images
• Specific processing times (video generation typically takes 1–3 minutes depending on the tool)
• Compatibility with all publishing platforms or devices
• Specific visual outcomes from AI generation

We reserve the right to modify, suspend, or discontinue the service with reasonable notice.

8. Prohibited Uses

You may not use VidHero to:

• Generate content that violates any laws or regulations
• Create misleading, false, or harmful information
• Generate deepfakes or impersonate others without consent
• Create explicit, offensive, or inappropriate content of any kind
• Attempt to abuse or overload our systems
• Share your account credentials with others
• Use the service to compete directly with VidHero
• Generate content that infringes on others' intellectual property
• Violate anyone's privacy or publicity rights

8a. Acceptable Use Policy — Content Safety

VidHero is a platform for creative and fun AI video generation. The following content is strictly and explicitly prohibited on our platform, regardless of intent, framing, or context:

• Sexually explicit content: Any generation of sexually explicit material, pornography, nudity, or sexual acts — including simulated, animated, or AI-generated depictions.
• NSFW content: Any content that would be considered inappropriate for general audiences, workplaces, or public platforms.
• Adult content: Content intended for adults only that depicts, suggests, or promotes sexual themes, sexual violence, or non-consensual acts of any kind.
• Child sexual abuse material (CSAM): Any depiction — real or AI-generated — of minors in sexual contexts. This is illegal and will be reported to the appropriate authorities.
• Graphic violence or gore: Content designed to shock, disturb, or glorify extreme violence or bodily harm.
• Hate speech and discrimination: Content that promotes hatred, discrimination, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or nationality.

VidHero monitors platform use and reviews reported content. Any account found generating, distributing, or attempting to generate prohibited content will be:

• Immediately suspended without refund
• Permanently banned from the platform
• Reported to relevant authorities where required by law

If you encounter prohibited content or suspect misuse, please report it to contact@vidhero.app.

9. Limitation of Liability

To the maximum extent permitted by law, VidHero shall not be liable for any indirect, incidental, special, consequential, or punitive damages including loss of profits, data, use, goodwill, or other intangible losses resulting from your use of or inability to use the service; any errors or inaccuracies in generated content; any unauthorized access to our servers; or any interruption in service.

Our total liability to you for all claims relating to the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Refund Policy

Due to the nature of our AI service:

• All subscription and credit purchases are final and non-refundable
• In the case of verified technical failures (e.g. a generation error that deducted credits without producing a video), we may provide credit compensation
• Contact support if you experience significant service issues

11. Account Termination

Either party may terminate this agreement at any time. Upon termination:

• Your access to VidHero will be suspended
• You retain ownership of all generated and downloaded content
• We may delete your account data after 90 days (upon request)
• No refunds will be provided for unused credits or remaining subscription time
• You should download any videos you wish to keep before closing your account

We reserve the right to terminate accounts that violate these terms or engage in prohibited activities.

12. Changes to Terms

We reserve the right to update these Terms and Conditions at any time. We will notify users of any material changes via email or through our platform. Continued use of the service after changes constitutes acceptance of the new terms.

13. Governing Law

These Terms shall be governed and construed in accordance with applicable laws, without regard to conflict of law provisions.
